A man who pleaded no contest for motor vehicle homicide, a class 1 misdemeanor, failed to appear for his sentencing on April 18.
Jayesh Desai, 56, of Mumbai, India, was found guilty of motor vehicle homicide in Box Butte County Court and his sentencing was set for April 18. The charge spawns from an incident in September 2022.
According to the Affidavit for Custody, the Nebraska State Patrol was dispatched to the intersection of Highway 385 and Link 7 E in Box Butte County on Sept. 10 regarding a car vs. motorcycle collision. The motorcycle rider, Kirby Schimmels, 77, of Houston, Texas, was transported to Box Butte General Hospital, where he was pronounced deceased.
According to the affidavit, the investigation showed that Schimmels was northbound on Highway 385 when a Nissan Sentra that was driven by Desai failed to yield at a stop sign and collided with the motorcycle. Desai was arrested and transported to the Box Butte County Jail, where his bond was set at $50,000–10 percent. The bond was filed on Sept. 12.
After failing to appear for sentencing, a bench warrant was issued for Desai’s arrest.
